第一章 总则
第一条 为了加强公共汽车客运管理，维护公共汽车客运秩序，提高客运服务质量，保障乘客、经营者和从业人员的合法权益，根据本市实际情况，制定本条例。
第二条 本条例适用于本市行政区域内公共汽车客运的规划、建设、经营及其相关的管理活动。 本条例所称的公共汽车客运，是指利用公共汽车在本市行政区域内按照固定编码、线路、站点和规定的时间运载乘客，并按照政府核定价格收费的交通方式。
第三条 市城市管理部门是本市公共汽车客运的行政主管部门，负责本市公共汽车客运管理工作。市公共汽车客运管理机构受市城市管理部门委托，负责本市市区公共汽车客运的具体管理工作。
县（市）公共汽车客运行政主管部门由县（市）人民政府确定，负责本行政区域内的公共汽车客运管理工作。
公安、交通、建设、规划等行政主管部门按照各自职责，协同做好公共汽车客运管理工作。
第四条 公共汽车客运的发展，应当与经济发展、城市建设、环境保护和人民生活水平相适应，符合城市总体规划，并与其他公共客运方式相协调。
各级人民政府应当对公共汽车客运的发展给予扶持，在城市规划、建设、管理和资金投入等方面保障公共交通优先，并建立合理的运行机制和价格机制。
第五条 公共汽车客运经营应当遵循统一管理、公平竞争、安全营运、优质服务、便利公众的原则。鼓励在公共汽车客运的经营和管理领域应用先进的科学技术及管理方法。
第二章 规划与建设
第六条 公共汽车客运行政主管部门应当会同规划、建设、交通、公安等行政主管部门编制公共汽车客运规划，报同级人民政府批准后，纳入城市总体规划。

第九条 公共汽车客运规划确定的公共汽车场站设施用地和空间，任何单位和个人不得侵占或者擅自改变其使用性质。 本条例所称的公共汽车场站设施，是指为公共汽车客运提供服务的停车场、保养场、首末站、途经站、枢纽站以及站牌、栏杆等其他相关设施。
第十条 公共汽车场站设施的建设资金以政府投入为主，市和县（市）人民政府应当加大对公共汽车场站设施建设的投入，鼓励、支持社会力量参与公共汽车场站设施的建设和经营。
第十一条 新建、改建、扩建公共汽车场站设施，应当符合公共汽车客运规划。
新城区开发、旧城区改造，飞机场、火车站、长途汽车站、客运码头、大型公共活动场所和具有一定规模的居住区等工程项目的建设，建设单位应当按照公共汽车客运规划配套建设公共汽车首末站，并与主体工程同步设计、同步施工、同步验收。
第十二条 新建、改建、扩建城市道路，应当根据公共汽车客运规划设置公共汽车候车亭和港湾式停靠站点；道路交通条件许可的，应当设置公共汽车专用车道和优先通行标志；在客流相对集中的地段，应当设置公共汽车换乘中心。
公共汽车专用车道开设和优先通行标志设置及站点设置的具体办法由公共汽车客运行政主管部门会同公安、规划、建设行政主管部门制定。

第三章 经营权
第十四条 在本市行政区域内从事公共汽车客运经营，经营者应当取得市或县（市）公共汽车客运行政主管部门授予的线路经营权。 第十五条 线路经营权的授予，应当采取招投标等公平竞争的方式。
招投标应当依照《中华人民共和国招标投标法》和其他有关法律、法规规定执行。中标后，由市或县（市）公共汽车客运行政主管部门发给线路经营权证，并在新闻媒体上予以公示。 线路经营权取得后，经营者不得擅自以转让、出租、承包、入股、质押、带车挂靠等方式予以处分。
第十六条 线路经营权竞标者应当具备下列条件： （一）依法注册的企业法人；
（二）有与其经营规模相适应的客运车辆或者相应的车辆购置资金；
（三）有与经营业务相适应的从业人员；
（四）有合理、可行的营运方案和健全的管理制度； （五）法律、法规规定的其他条件。
第十七条 公共汽车客运行政主管部门应当与取得线路经营权的经营者签订公共汽车客运线路经营合同。线路经营合同的内容应当包括运营线路、站点、班次及其间隔时间、车辆数、车型、车辆载客限额、票价、经营服务质量标准、经营评估和考核、经营期限、违约责任等应当由经营者履行的义务和主管部门履行的职责。 线路经营权每期不得超过十年。经营者在线路经营合同有效期限内提出解除合同的，应当提前提出书面申请，公共汽车客运行政主管部门应当自收到申请后三个月内作出书面答复，逾期未作出书面答复的视为同意解除合同；在公共汽车客运行政主管部门同意前，经营者应当继续履行合同。
公共汽车客运行政主管部门应当按照线路经营合同规定的经营车辆数量发放公共汽车线路经营证。经营者不得涂改、伪造、转让、出借公共汽车线路经营证。
第十八条 经营者在线路经营合同期限内有下列情形之一的，市或县（市）公共汽车客运行政主管部门应当解除线路经营合同，撤销其线路经营权，并可以实施临时接管：

（三）擅自停业、歇业，影响社会公共利益的；
（四）发生重大安全生产责任事故或有其他重大违法行为的； （五）经营服务质量评估不合格的；
（六）丧失本条例第十六条规定的条件的。
公共汽车客运行政主管部门依照前款规定撤销线路经营权并实施临时接管的，应当按照有关法律、法规的规定进行，并组织听证。
第四章 客运管理
第十九条 经营者应当遵守下列规定：
（一）遵守公共汽车客运管理的法律、法规、规章，执行行业标准、规范、规程；
（二）加强从业人员职业素质培训，健全服务质量管理制度； （三）加强公共安全教育和行车安全管理，保证运营安全； （四）按规定对营运设施进行保养和维修，保证其处于良好的运营服务状态；
（五）接受乘客监督，受理乘客投诉； （六）执行政府制定的客运价格。
第二十条 经营者应当按照线路经营合同约定的线路、站点、班次及其间隔时间、车辆数、车型、车辆载客限额、票价组织运营，不得擅自变更线路运营或者停运。 第二十一条 线路计划调整的，公共汽车客运行政主管部门可以要求经营者实施运营调整，经营者应当执行。
道路、地下管线等城市基础设施施工及其他道路状况影响运营的，公共汽车客运行政主管部门根据公安、建设等行政主管部门提出的意见，可以要求经营者实施运营调整，经营者应当执行。 经营者根据本条规定实施运营调整的，应当于实施之日的三日前在线路各站点公开告示。
第二十二条 有下列情形之一的，经营者应当按照公共汽车客运行政主管部门的统一调度，及时组织车辆、人员进行疏运： （一）抢险救灾的；
（二）举行重大社会活动的； （三）其他应急疏运事务。
第二十三条 公共汽车车票价格实行政府定价。公共汽车车票价格确定前，价格主管部门应当会同公共汽车客运行政主管部门组织听证。

公共汽车客运行政主管部门应当以所在道路、居住区、镇（村）、标志性建筑物、公共设施、文物古迹等的标准名称命名公共汽车客运线路站点，同一站点的名称应当统一。
公共汽车客运线路站点应当按照统一标准设置线路站牌。线路站牌应当标明线路编码、首末班和班次间隔时间、所在站点和沿途停靠站点的名称、开往方向、运营收费标准、服务和投诉电话等内容，并保持清晰、完好；运营班次间隔在三十分钟以上的线路，应当标明每一班次车辆途经所在站点的时间。
第三十五条 除公共汽车和特种车辆外，公共汽车客运站点禁止其他车辆停放或占用、堆放物品。
第三十六条 任何单位和个人不得擅自迁移、拆除、占用、毁坏或者污损、遮盖公共汽车场站设施。
因城市建设需要迁移、拆除公共汽车场站设施的，建设单位应当按照规划先行补建。
第三十七条 在公共汽车线路站牌、候车亭设置广告，应当符合国家有关广告管理和公共汽车场站设施管理的规定。
第六章 法律责任
第三十八条 违反本条例规定，有下列行为之一的，由公共汽车客运行政主管部门责令停止违法行为，没收违法所得，并可处以两万元以上五万元以下罚款：

（一）不按照公共汽车客运行政主管部门的要求和统一调度实施运营调整、组织疏运的；
（二）未按核准的线路、站点、班次、时间组织运营的；
（三）运营车辆不符合本条例第二十四条第（二）项至第（五）项规定的。
第四十一条 驾驶员、乘务员违反本条例第二十七条规定的，由公共汽车客运行政主管部门责令改正，拒不改正的，可处以五十元以上五百元以下的罚款。
第四十二条 违反本条例规定，涉及其他法律、法规的，由有关行政主管部门依照其他法律、法规予以处罚；构成犯罪的，依法追究刑事责任。
第四十三条 公共汽车客运行政主管部门及其工作人员在公共汽车客运管理过程中违反本条例规定，有下列情形之一的，由所在单位或上级主管部门依法给予行政处分；构成犯罪的，依法追究刑事责任。
（一）对不符合法定条件的竞标者授予经营权的； （二）不履行线路经营合同约定的监督管理职责的；
（三）未建立公共汽车客运投诉受理制度和服务质量评估制度，或者对乘客投诉不予受理和答复的；
（四）其他玩忽职守、滥用职权、徇私舞弊行为。
第七章 附则
第四十四条 本条例施行前已经从事公共汽车线路运营的经营者，符合本条例规定条件的，应当向市公共汽车客运行政主管部门办理线路经营权手续并确定经营期限，经营期限已有约定的，从其约定；不符合本条例规定条件，经限期整改仍达不到要求的，应当撤销其线路经营权。
第四十五条 本条例自2005年7月1日起施行。
